Welcome to ClearBreath. By accessing or using our mobile application or website ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use ClearBreath.

1. Use of the Service

ClearBreath grants you a personal, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes.

• You are responsible for ensuring that your use of the Service complies with all local laws and regulations.
• You may not use the Service in a manner that could disable, overburden, or impair our infrastructure.
• You may not attempt to reverse engineer, decompile, or otherwise extract the source code of the Service.

2. Accounts and Leaderboard

While ClearBreath functions primarily offline, you may choose to create an account for cloud synchronization and leaderboard access.

• You are responsible for maintaining the confidentiality of your authentication credentials.
• When participating in the leaderboard, your chosen display name must not contain profanity, hate speech, or impersonate others. We reserve the right to alter display names, remove users from the leaderboard, or shadow-ban accounts that violate this rule or engage in cheating (e.g., submitting fraudulent session data).

3. Content and Intellectual Property

All content, visual interfaces, interactive features, information, graphics, design, and other elements of the Service are the property of ClearBreath or its licensors. You may not reproduce, distribute, or create derivative works from this content without express written permission.

4. Availability and Modifications

We strive to keep ClearBreath running smoothly, but we do not guarantee that the Service will be uninterrupted or error-free. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

5. Limitation of Liability

To the maximum extent permitted by applicable law, ClearBreath, its developers, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service.
• Any conduct or content of any third party on the Service.
• Any health or medical issues arising from your use of the breathing techniques provided by the Service.

6. Indemnification

You agree to indemnify, defend, and hold harmless ClearBreath from any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the creators of ClearBreath operate, without regard to its conflict of law provisions.
